COVENANTS
The Grantor will NOT:
1. Erect or place or permit to be erected or placed on any of the lots specified in stage one of The Cairns, any second-hand or relocated building nor any caravan, hut, shed or tent to be used as a dwelling or temporary dwelling.
2. Construct any building on any of the Lots specified in stage one of The Cairns that fails to comply with the provisions of any Mackenzie District Plan relating to the Residential 1 zone including but not limited to any provisions or rules as to front, side ad rear yard requirements, recession planes and color or style of buildings.
3. Construct any building on any of the Lots specified in stage one of the Cairns using as external cladding any flat plywood sheeting or any flat fibre-cement sheeting or any product commonly known as “fibrolite”. "Hardiflex” or “hardiplank” unless such sheeting or product is used in association with a textured finish, provided that nothing in this provision shall apply to the construction of and soffit forming part of any such belonging.
4. Construct any building on any of the Lots specified in stage one of The Cairns or any part of such lot that does not comply with the Mackenzie District Council color palette for Lake Tekapo as specified in and Mackenzie District Council Plan.
5. Construct any fencing on the boundaries of, or within any of the lots except to the extent that the maximum area of each lot which may be enclosed by a fence shall be 250 square metres and shall not exceed 1.5 metres in height above natural ground level.
6. Allow any grass or weeds on any of the Lots specified in stage one of The Cairns to exceed 100 millimetres in height.
7. Allow rubbish or waste materials to accumulate on any of the lots specified in stage one of The Cairns or allow any of such lots to become untidy or unsightly.
8. Erect, build, place or suffer to be upon any part of the following lots any building structure, erection, landscaping or vegetation of a greater height than specified.
9. Further subdivide the property. It is acknowledged that this shall not prohibit boundary adjustments.
10. The Grantor shall not be liable to pay or contribute towards the expense or erection or maintenance of any fence between the property and any contiguous land of the Grantor but this proviso shall not endure for the benefit of any subsequent purchase of the land
11. The Grantor shall be liable only in respect to breaches of such stipulation, restrictions and covenants which occur while the Grantor is the registered proprietor of the lot or lots in respect of which any such breach shall occur.
12. The Owners and Occupiers for the time being of the dominant lots may enforce the observance of such stipulations against the owners for the time being of the servient lots. The Grantor covenants and agrees to the extent that for the benefit of the dominant lots the covenants run with the servient lots to be forever for the benefit of the dominant lots. Height covenants are set out in the above information.
